Planning Appeals


Aitchison Raffety have been appointed to act on behalf of a number of Local Planning Authorities and Parish Councils. This has included the successful defence of Planning Committee overturns of proposals at appeal, and representations on behalf of Parish Councils as an Interested Third Party at appeals. Projects undertaken by Aitchison Raffefty include the following:


  • 36 Dwellings at Bozeat on behalf of the Borough Council of Wellingborough. The appeal was dismissed and a High Court challenge also dismissed. The main issues debated were:
    • Housing land supply; and
    • Sustainability of development within a restricted infill village.
  • Change of use of a storage and distribution warehouse (Class B8) to a mixed use office, general industrial and storage use (Class B1a, B2 and B8) on behalf of St Albans City and District Council. The main issues was the impact of the proposal upon the living conditions of nearby residential properties by reason of odour and noise disturbance. The appeal was dismissed.
  • Replacement of three houses with a 27 sheltered apartments for the elderly on behalf of Stratford on Avon District Council. The appeal was dismissed. The main issues were:
    • Impact upon heritage assets (listed buildings and conservation area);
    • Design and appearance;
    • Parking issues and accessibility;
    • Impact on local infrastructure; and
    • Sustainability (paragraph 14 assessment).
